Melee Instead of Shooting

I have replicated a number of times now in the most random of situations, the last being a gunfight i entered into when running up on a runner, i melee instead of shoot. After the animation is complete i'm already losing out on the encounter from this. It consistently melee's when i am out of ammo and then i press the reload button.

I tried replicating the issue but am unable to. I think it may have some combination of factors involved to occur.
However, it would be great if i did not melee when my bullet count reaches 0 (zero). I think whatever is causing the melee in gun fights instead of shooting when i have bullets is rooted in the melee'ing when i am at 0 (zero.
